A nonimmigrant is defined as a foreign national (alien) who seeks to enter the US for a temporary period of time. The activities of nonimmigrant are restricted based upon the type of temporary visa issued.

General Requirements for Temporary Visas

Admission of temporary visitors to the US is based upon, but not restricted to, the following requirements:

  • the purpose of the visit is strictly temporary;

  • the foreign national agree to depart at the end of his/her visa or extension

  • the foreign national carries a legal and valid passport

  • the foreign national is able to show proof of financial support

  • a foreign residence must be maintained by the foreign national

  • the foreign national abide by the terms and conditions of Immigration Laws.

Temporary Visa Extension

Visa extension is permissible under certain conditions:

  • the foreign national carries a lawful temporary visa with eligibility for an extension

  • the foreign national is not engaged in criminal activity or commits an act that eliminates his/her eligibility for an extension

  • the foreign national must apply for an extension before his current authorized visitor status expires.
