Obtaining Green Card Through Adoption

Adoption of a foreign child by American parents are subjected to immigration regulations by the Bureau of Citizenship and Immigration Services (BCIS) and of the foreign country where the adopted child resides. The US Immigration Law and its adoption requirements are designed to protect the adopted child, the adoptive parents, and the birth parents.

Adoptive parents need to satisfy all the foreign adoption requirements as defined by US Immigration Law. BCIS determines whether the adoptive parents are able to provide decent and proper care for the prospective adopted child. BCIS will also determine if the child qualifies as an orphan as defined by the US Immigration Law and wheter the adoption process meet all the legal requirements.

In summary, there are 3 different types of adoption procedures:

  1. Advance Processing (I-600A) - adoption application where an adopted child has not been specified by prospective parents. This application is required for submission to local BCIS office with jurisdiction over the adopted parents' state of residence.

  2. Petition to Classify Orphan as an Immediate Relative ( I-600) - adoption application where prospective child has been identified.

  3. Petition for Alien Relative (Form I -130) - adoption application for a prospective child who has been in adoptive parents' legal and physical custody for over two years. Adoptive child has to be under 16 years of age to qualify.
